JUDGEMENT
MILAP CHANDRA, J. -
(1.) HEARD . It has been contended by the learned Counsel for the accused -petitioner Amba Lal that he also lodged a report against the complainant Dharam Chand and his brother Jagdish within 24 hours of the occurrence. Amba Lal also received three injuries including two injuries caused by some sharp edged weapon injured. Dharam Chand received only six simple injuries. It has further been contended that there exists old enmity between the parties.
(2.) THE learned Public Prosecutor has contended that injured Dharam Chand received injuries on the vital parts of his body and the accused petitioner received injuries during the scuffle from his own weapon.
Having regard to all the facts and circumstances of the case, it is directed that the petitioner Amba Lal in the event of his arrest by the Officer Incharge of the Police Station, Charbhuja on the accusation made against him in FIR No. 29/88 of the said Police Station on the basis of which a case u/sections 324, 307 has been registered against him, be released on furnishing a personal bond in the some of Rs. 5,000/ - together with two sureties each in the sum of Rs. 2,500/ - to the satisfaction of the Officer in -charge of the said Police Station to appear before him in connection with interrogation of the said case registered at the said Police Station when ever called upon to do so and in this direction of this Court following conditions are also imposed on the petitioner:
(i) that the petitioner shall make himself available for interrogation by a Police Officer as and when required; (ii) that the petitioner shall not directly or indirectly make any inducement threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any Police Officer; and (iii) that the petitioner shall not leave India without previous permission of the Court.
