JUDGEMENT

P.K.LOHRA,J. - (1.) Petitioner, Mohan Kanwar Bhansali is dependent and widow of Late Hansraj Bhansali, who died while in serving on the post of Junior Clerk in City Treasury, Jodhpur. The petitioner being his wife was issued PPO and Medical Card. She suffered cardiac problem and remained under treatment of Cardiology Department and her Angioplasty was also done at MDM Hospital. For undergoing the treatment she raised the bill for reimbursement of the expenditure incurred in her treatment to the tune of Rs. 2,15,450 before competent authority with application. However, the amount incurred in treatment was not reimbursed in full as such she submitted representation. The representation of the petitioner too did not found favour of the respondents.

Learned counsel for the petitioner submits that petitioner is entitled to reimbursement of the medical expenses incurred by her in full as she is wife of a deceased Government servant and the treatment was taken at a Government Hospital. Learned counsel would contend that while undergoing angioplasty at MDM Hospital, Jodhpur, PTCA stents and PTCA Bulbs were not available at the Govt. authorized medical store and therefore petitioner was forced to purchase them from other medical store. In support thereof, learned counsel has placed reliance on Non Available Certificate issued by the authorized medical store as well as bill of total expenditure signed by Professor and Unit Incharge of Cardiology Department, MDM Hospital, Jodhpur.

Per contra, learned counsel for respondents stated that reimbursement of medical expenses to the petitioner has been made as per rules which provide rates fixed for DE Stant and PTCA Angioplasty and therefore, the petitioner is not entitled to any further amount in connection with the disputed medical bills.;
