P.K.LOHRA,J. - (1.) Matter is listed on the application of petitioners for early listing of the case. The application is allowed for the reasons mentioned therein and the matter is taken up for hearing today itself.
(2.) In the instant petition, the petitioners have mainly craved for following reliefs: i. The action of the respondents in effecting recoveries from the petitioners may kindly be directed to be treated illegal and consequent to aforesaid, the same may be ordered to be refunded to them with interest. ii. That it may also be directed that on release of third selection grade petitioners are entitled for the pay of the post of A.En. And as such the consequent re-fixation of the pay and arrears of salary may also be directed to be released in favour of petitioners with interest. iii. That as a result of aforesaid exercise, retiral dues of the petitioners may also be directed to be revised and paid accordingly to petitioners with interest.

Facts in brief, as narrated in the petition are that petitioners No.1 to 3 Somdutt Kachhwah, Mohan Singh and Panna Lal Sagar, who are retired employees of PHED, were initially appointed respectively as Pump Driver Gr.III Fitter Gr.II and Pump Driver Gr.III in the years 1977, 1979 and 1976. The State Govt. vide order dated 07.03.1979, merged the posts of Pump Driver Gr.II and III as Pump Driver Gr.II and on completion of 9 years of services they were given the pay scale of 1200-2050 which is the pay of scale of the post of Pump Driver Gr.I. Later on pay scales were revised in the year 1998 and they were given second selection grade in the pay scale of 1400-2000 on completion of 18 years of services but on the basis of re-revised pay scales recovery is sought from them.;
