JUDGEMENT

NIRMALJIT KAUR,J. - (1.) Both these writ petitions shall stand decided by this common order as the issue involved is identical.
(2.) The respondent no. 1 invited applications for admission to Bachelor of Unani Medicine and Surgery (in short 'BUMS'). For the said course, an examination named "Rajasthan Pre Unani Test-2017" was conducted. The petitioner cleared the said examination and was granted admission and was declared successful. In pursuance to the counselling, the petitioner was secured admission in the Rajasthan Unani Medical College and Hospital, Jagdamba, Jaipur. The said college is affiliated with the respondent no. 1 - Dr. Sarvepalli Radhakrishanan Raj. Ayurved University, Nagaur Road, Karwad, Jodhpur. After depositing of heavy fees with the respondent Nos. 1 and 2, the petitioner was allowed to attend the classes. Suddenly, admission of the petitioner was cancelled vide letter dated 20/11/2017 issued by the respondent no. 1 on the ground that the certificate of the petitioner regarding Urdu Language as given to her by the U.P. Board of Madarsa Education, Lucknow is not valid for the purpose of seeking admission to BUMS course. While issuing the notice on 06/12/2017, the petitioner was allowed to attend the classes at her/his own risk. Today, the matter has come up on an application under Article 226 (3) of the Constitution of India for vacation of the said interim order.
(3.) Reply too has been filed. As per the reply, the admission has been cancelled because the petitioner did not pass class 12 (at this stage, learned counsel for the respondents pointed out that he has wrongly mentioned Class 12. It was meant Class 10) from the recognised State Board with Urdu as required by the University. The advertisement was clear and the petitioner's reliance on the Gazette notification dated 07.11.2016 is of no help to the petitioner because the same is for admission to Pre-Tip Course which is for one year duration and is a diploma course while the requirement for the BMUS (4.5 year degree course) is absolutely clear.;
