JUDGEMENT

K.S.JHAVERI,J. - (1.) The Joint Inspection report submitted by Mr. S.L. Songara counsel for the petitioner as well as Mr. Shyam Arya, AAG reads as under:- "The counsel for Petitioner and counsel for State submit the Joint Report Regarding visit of Zanana Hospital, Jaipur, Pandit Deen Dayal Upadhyay Rajkiya Chikitaslya Gangauri Bazar, Mahila Chikitaslya Sanganeri Gate and J K Lone Hispital, Jaipur on 2 September 2017 as under:- A. Zanana Hospital, Jaipur 1. That Joint Inspection of the Zanana Hospital, Jaipur was conducted on 2.9.2017 with Officer in Charge of the Case. 2. That the operation theatres are neat and clean. 3. That there is a pre-delivery ward having 24 beds, where the lady patients having labour pain are waiting for delivery is neat and clean. 4. There is a post delivery ward having 30 beds, which is neat and clean. There is no sharing of the bed in this Ward. 5. There is also postnatal wad Nos. 1 and 2 having 16 and 26 beds respectively. The patient are shifted here after delivery. Both the wards are neat and clean and without any sharing. 6. There is a one Septic Medical Ward having 32 beds. This Ward was for the patient due to some complications before the delivery. This Ward is also neat and clean and there is no sharing. 7. There are 5 Gyny postoperative ward. There are 31 beds in ward No. G1, the G2 Ward having 25 beds, Ward No. G3 having 15 beds, a wad No G4 having 16 beds and Ward No. G5 having 63 beds. All the five wards are neat and clean and there is no sharing on the bed. 8. There are also private rooms for the patients on payment, out of which three are free of cost. The private rooms are neat and clean. 9. That the Bed Sheets are in 7 colors each day has fixed the one clolor. On 2.9.2017 the day was Saturday and on that day the Purple color fixed and we found that all the bed sheets were of Purple. This fact also verified by the patients also. 10. The toilets of the hospital are up to our satisfaction. Some of are dirty. We have also found there is leakage in several Taps. The water is flowing without any purpose. 11. That there is newly constructed Toilet for the attendants of the patients but was locked, since, the toilet was locked it could be ascertain that the toilet was for both ladies and Gents or only for ladies. The separate toilets are required for Ladies and Gents for the attendants of the lady patients. It was informed by the gents attendant that they are using the Urinals outside the hospital, which is on road, constructed by the Municipal Corporation, Jaipur. The Urinals are in worse condition and hygienic. Facilities and Improvements Required 1. That the Zanana Hospital, Jaipur is a referral hospital in the Jaipur Division. The parking place is insufficient and required more parking facilities for Ambulance and other vehicles of the patients and their visitors. We are of view that the underground parking should be constructed at the backside of the Hospital. 2. That newly constructed OPD is situated at the back portion of the Hospital. The Bungalow and quarters of the doctors and nursing staff is attached to the back part of the Hospital. There is problem of stray dogs in the area of OPD and bungalow and quarters of the medical staff. One Dr. Swati Yadav is one of the victim of dog bitting. We are of the view that boundary wall of the back portion of the hospital should be raised to avoid the entry of the stray dogs. 3. That there are several kiosk and Thadis situated outside the main gate of the Hospital, sometimes they became the hurdles for entry. The kiosk and Thadis should be shifted to the backside of the hospital, as the backside is also open to main Chandpole to Jhotwara Road. 4. That Bhamashah Yojana required more vigilance from the hospital administration as some of the patient complained in this regard that the medicines are available. 5. The new toilets are required for the attendants of the patient in the Hospital. B. Pandit Deen Dayal Upadhyay Rajkiya Chikitaslya Gangauri Bazar, Jaipur 1. That the Pandit Deen Dayal Upadhyay Rajkiya Chikitaslya Gangauri Bazar, Jaipur is of 5 floor General Hospital. There are several OPD. The Gynee OPD was working smoothly. 2. That there is also a centre for family welfare counseling, where two nurses were present and counseling female patients. 3. There is also a minor operation theatre, which was also neat and clean. 4. There is also a centre for immunization, which was neat and clean and one patient was present.' 5. There is also an isolation ward having 7 beds, all beds are unoccupied. The Ward was neat and clean. 6. There is also a intensive care unit, which was also neat and clean having 10 beds. 7. There is a Neo Natal Intensive Care Unit highly hygienic, neat and clean, having 15 beds, out of which the some patient occupied beds. 8. There is a award of KMC (Kangaroo Mother Care) having 15 tables/beds out of which 4 were occupied. 9. That the lady Antenatal Care Ward having 18 beds, neat and clean, some 12 patients occupied the beds and there is no sharing. 10. That there are 2 labour rooms, both are neat and clean. One is used in morning and another is used in night, being used alternate after fumigation. 11. There is a pre-delivery room having 15 beds and there is no sharing. The Ward is neat and clean. 12. There is an operation theatre having 3 barriers. The operation theatre was neat and clean and also very hygienic. 13. There is also Surgery and Orthopedic Male having 11 beds out of which three were occupied. The Ward was neat and clean. 14. That there is Female Surgery Ward having 10 beds out of which eight were occupied. The Ward was neat and clean. 15. There is also Female Orthopedic Ward having 7 beds, all were vacant. The Ward was neat and clean. 16. That there is one Gynae. Postoperative Ward having 25 beds, out of which some were occupied. The Ward was neat and clean. 17. That there is also JSY (Janani Surksha Yojana) Ward having 15 beds, in which some patients occupied the beds. 18. That there is a Gynee Ward No.2 having three segments. In Room No.14, there are 20 beds, of out of which 10 occupied. Room No.15 was for Post Natal patients having 8 beds, all were occupied. Room No.16 there are 9 beds, out of which 2 occupied. The Ward was neat and clean. 19. That in Ward No.T 15 and T 16 there are 10 and 20 beds. Out of which 2 patients were found in each Ward. 20. The operation theatres of Orthopedic and Eye are neat and clean having best management. 21. That the Blood Bank is also working as the best of the best, having cross match and transfusion facilities are available. 22. There is also a section of X-Ray having the machine of ACR for digital processing of x-ray. 23. There is a highly equipped Modern Central Laboratory where 57 tests are free and other all tests are being conducted on the lowest rate as at the rate of SMS Hospital. The Superintendent informed that all Test are being conducted 24 hours. 24. That there is a proper disposal of Bio Waste. There is also heavy-duty vacuum machine for cleanness. 25. There is fully automatic and computerized machine for Blood Count. The biometric attendance system is working in the laboratory. The Sonography machine is sitated in the basement.' 26. That as per the version of Superintendent of the hospital, it is a multy facilities hospital in the city wall of the Jaipur city. 27. That the entire hospital is very neat and clean. The Superintendent of the hospital sent the report of 3 years to Additional Advocate General. The Microbiology Department of SMS Hospital is monthly inspecting the hospital regarding bacteria. The hospital is Bacteria Free Hospital for large three-year. C. Mahila Chikitaslya Sanganeri Gate 1. That the building of the hospital was constructed in the year of 1911 but now it has been renovated nicely and in modernize way. 2. The Ward No.3 having 39 beds out of which 34 were occupied by the patients. The Ward is neat and clean. 3. That there is Septic Labour Room having 15 beds out of which 12 beds occupied by the patients. The Ward is neat and clean. 4. That there is Isolation Ward having 4 beds out of which 1 bed occupied by the patient. The Ward is neat and clean. 5. That there is Day-Care Ward having 10 beds all beds occupied by the patients. The Ward is neat and clean. 6. That there is Eclampisa Ward having to segment, in one segment there are 9 beds for acute patient out of which 5 beds occupied by the patients. There is another segment is for managed patient, in the segment there are 14 beds out of which 8 were occupied. The Ward is neat and clean. 7. That the Labour Room adjacent to main road of the hospital so the emergency patient may reach easily. There are 24 beds out of which 16 are occupied by the patients. There is also a space available for extra beds in the need of emergency. The Ward is neat and clean. 8. There are two labour rooms having 14 and 12 tables. Both are used alternatively in day and night. 9. That ward no.7 is for postoperative ward for the patients of lower segment casesarean section. There are 30 beds, out of which 14 are occupied by the patients. 10. That the Ward No.8 for postoperative General Ward, in which there are 30 beds out of which 29 occupied by the patients. 11. That there is a blood bank, which is running smoothly. The hospital has a right for component licence, which will be given to law Central very soon as per version of Superintendent of the hospital. In the Laboratory there is three wings namely Pathology, Haematology and Biochem. All the Medical investigations are available in the hospital. 12. That the Ward No 5 is postoperative Ward having 21 beds and the patients occupy all. The Ward No 6 is maternity Ward having 50 beds out of which 39 beds were occupied by the patients of Unit V and VI. In the Gyny Ward there are 48 beds out of which 40 beds are occupied by the patients. The wards are neat and clean. 13. That there is a Milk Bank (Human Milk Bank), which is a unique and only one in the Rajasthan. The Swidine donated the machine. Mr Paula Bolla, Project Leader of Medela Corporate Social Responsibility Project. There is a same complaint of shortage of manpower. Some more manpower required in the Hospital. 14. That there is a highly hygienic, neat and clean Neo Natal Intensive Care Unit having 23 tables for newly born child. The 18 beds for the mothers of children, out of which 17 beds occupied by the mothers of the children in ward. 15. That there is also "Palana" for the person, who is intended to take care the child, may leave the child there. 16. That there is a very good spacious roofed waiting area for the attendant outside the hospital. Facilities and Improvements Required 1. That it was the main complaint of the doctors and nursing staff that thare is acute shortage of class IVth employees. We are of view that the staff of class Ivth employees should be increased. 2. That this hospital is situated in front of Sanganeri Gate, which is one of the most crowded point of the Jaipur city. After inspection we found that one way may be assess from the Ram Niwas Garden so the patient from the nearby area may easily approach to the Hospital. After consultation with the hospital staff we found one point nearby garage is suitable for Road to the Ram Niwas Garden should be opened for the convenience of female patients. D. J K Lone Hospital, Jaipur 1. That the J K Lone Hospital, Jaipur is a referral hospital in the State. The patients of the adjoining states also come here for treatment as the free medicines and treatment are is being given in the hospital. The hospital treating the child patients for general disease and also the patient of following category: I. Haemophilia II. Thalassaemia III. Blood Cancer IV. Renal disorder V. Surgery VI. Heart disease VII. HIV VIII. Surfactant (premature kids having lungs problem) IX. Auto Immune Disorder 2. That there is a world of Neo Natal Intensive Care Unit having 60 beds. The mothers room is also attached for the kids who are in the Ward. 3. That there is also physiotherapy room in the hospital for the kids. 4. That in the hospital, there is a high dependency unit for the critically ill children's having 15 beds with ventilation. In this Ward the mothers are restricted to enter. 5. That there is a Ward namely KMC (Kangaroo Mother Care) for the children having low birth weight. 6. That there is a surgical unit for postoperative care having 29 beds, out of which 5 are occupied by the patients. 7. That there is a Ward for Hemophilia and Thalassaemia patients (Day-care) having 20 beds. 8. That there is a highly hygienic, neat and clean Dialysis Room for Peritoneal and Haemodialysis. 9. That in the hospital there is Pulmonary Ward having 45 beds, occupancy was hundred percent. The Ward is neat and clean and there is no sharing of bed. 10. There is a also a Cardiology Ward, which is highly hygienic, neat and clean. There is no sharing of bed in the Ward. 11. That there is a medical Medical Pediatric Ward. The ward is neat and clean but overcrowded. The bed is being sharing by two or three kids' patient. The reason was given by the hospital that the district hospitals of the State are competent to treat the patients but the family members insisted and pressurized the doctors of the district hospital to refer here. The doctors have no option to refer the patient here to avoid any complications in the hospital. The patients of adjoining states also come here, as the medicines and treatment are free. The hospital can't refuse them to admit the patient on the ground of humanity. Sometime looking to emergency, the patients are to be admitted looking to there serious condition. I have also taken the photograph of this ward. 12. That there is 8 Ward of Medical Unit, 4 Ward of Surgical Unit, 2 Ward of Neo Natal Intensive Care Unit, 2 Ward of Pediatrics 1 ward is for observation, 1 ward for Nephrology, 1 Ward for Cardiology, 1 ward for Nephrology, 1 Ward for Cardiology, 1 Ward is related to Pulmonary Disease, 1 Ward for Gastroentrology, 1 Ward for Blood Cancer disease and 1 Ward for Rare Disease. All the wards are neat and clean. 13. That in the hospital, there is Central fully Automatic Laboratory conducting all the tests. The Lab is highly hygienic, neat and clean. 14. That the Blood storage unit is running inthe hospital. Blood Bank is under process. At present blood is managed from the SMS Hospital, Jaipur."
(2.) We accept the report. The Government Official will look into the matter and give proper treatment to the suggestions given by the counsel and if they found any lapse, appropriate action will be taken against the erring officer/s. The petition stands disposed of. Writ Petition Disposed of as above.;
