JUDGEMENT

(1.) The petitioners have preferred this writ petition under Article 226 & 227 of the Constitution of India, claiming the following reliefs:
"(a) By an appropriate writ, order or direction, the order dated 25.09.2017 (Annexure-9) passed by learned Civil Judge, Shahpura District Bhilwara in Civil Suit No.166/2012 may kindly be quashed and set aside and the application (Annexure-7) with the prayer made inter-alia therein may kindly be allowed.
(b) Any other appropriate order or direction which this Hon'ble Court considers just and proper in the facts and circumstances of this case may kindly be passed in favour of the petitioner."
(2.) Learned counsel for the petitioner submits that the petitioner is a proper party and would be fruitful in adjudicating the suit as he is the son of tenant-defendant.
(3.) Learned counsel for the respondent has opposed the submissions of the learned counsel for the petitioner on the ground that the suit is for eviction and is directly between the owner and tenant. Learned counsel for the petitioner states that since the respondent is owner and the petitioner's father is the tenant therefore, no other parties required to be impleaded for adjudication of the suit.;
