JUDGEMENT
-
(1.) Petitioner has preferred this writ petition under Article 226 of the Constitution of India praying for the following reliefs :-
"It is, therefore, most humbly prayed that this writ petition may kindly be allowed by appropriate writ, order or direction the respondents may kindly be directed :-
1.That the impugned select list dated 04.10.2017 (Annex.3) may kindly be quashed and set aside and accordingly the selection of the respondent no.6 to 8 may be declared bad and illegal and be quashed.
2. That the respondent no.5 may be directed to allow 30 bonus marks to the petitioner for 3 years of experience according to his experience certificate and further it may be directed to recast the merit list of the candidates and accordingly the petitioner may be considered for appointment on the post of Panchayat Sahayak according to his merit.
3. That if during pendency of the writ petition the selection of the respondent no.6 to 8 are confirmed by the District level Committee ignoring the claim and representation of the petitioner, then the same may be declared bad and illegal and be quashed.
4. That any consequential appointment of the respondent no.6 to 8 by the present process of selection may be quashed and set aside.
5. The writ petition may be allowed with all consequential benefits.
6. That in alternate the respondent no.3 may be directed to decide the representation of the petitioner positively by considering the aspect of the allotment of bonus marks and till the decision of the same, the approval of appointment of respondent no.6 to 8 may be kept in abeyance.
7. Any other appropriate writ, order or direction which this Hon'ble Court may deem just and proper in the facts and circumstances of the case may kindly be passed in favour of the petitioner.
8. Costs of the writ petition may kindly be awarded to the petitioner."
(2.) Learned counsel for the petitioner states that the matter is squarely covered by the judgment rendered by a coordinate Bench of this Court in Bhoma Ram Vs. State of Rajasthan & Ors. (S.B. Civil Writ Petition No.6023/2017) decided on 01.06.2017.
(3.) Learned counsel for the petitioner also states that the matter is squarely covered by the judgment rendered by a coordinate Bench of this Court in Sunita Sharma Vs. State of Rajasthan & Ors. (S.B. Civil Writ Petition No.1032/2017) decided on 24.05.2017.;
