JUDGEMENT

ARUN BHANSALI,J. - (1.) This writ petition has been filed by the petitioner seeking a direction to the respondents to grant appointment to the petitioner in pursuance to the order dated 5/11/2015 passed in S.B.Civil Writ Petition No.11925/2015 and in S.B.Civil Writ Petition No.7322/2015 in the case of Kailash Solanki v. Registrar, Dr. Sarvepalli Radhakrishnan Rajasthan Ayurved University, Jodhpur and respondents may be directed to offer appointment on the post of Lower Division Clerk (LDC) as offered to Kailash Solanki and Ashok Dhanadia.

It is inter alia indicated in the writ petition that the respondent University issued an advertisement dated 6/5/2014 for the post of LDC, the petitioner applied for the same and participated in the selection process, wherein, he secured 138.22 marks. It is alleged that the respondents committed certain irregularities and illegalities in issuing select list dated 10/7/2015, wherein, name of the petitioner was not indicated. Feeling aggrieved, the petitioner filed S.B.Civil Writ Petition No.3649/2017, which came to be dismissed on 5/5/2018. It is claimed that the two candidates, Kailash Solanki and Ashok Dhanadia preferred S.B.Civil Writ Petition No.11925/2015 and 7322/2015 questioning the same recruitment process, in which writ petitions on 5/11/2015 certain directions were issued, pursuant thereto on 27/11/2015, on the statement of learned counsel for the respondents, the writ petitions were rendered as infructuous.

It is inter alia submitted in the writ petition that the petitioner sought information under Right to Information Act regarding position of vacant posts, wherein, it has been indicated that more than 09 posts are lying vacant. It is claimed that the case of the petitioner is similar to Kailash Solanki and Ashok Dhanadia and, therefore, the petitioner is also entitled to similar benefit. Based on the said submissions, reliefs as indicated hereinbefore has been claimed.;
