JUDGEMENT

(1.) Mrs. R.R. Kanwar, learned Dy. Govt. Counsel
frankly pointed out that the subject matter of this
writ petition stands concluded with the decision of
this Court in SB Civil Writ Petition No.6336/2007
(State of Raj Vs. Labour Inspector & ors.) decided on
31.10.2007 and followed by learned Single Judge of
this Court in SB Civil Writ Petition No.2276/2007
(State of Raj. Vs. Labour Inspector & Ors.), decided
on 10.1.2008.
(2.) This Court has considered the impugned order
dated 29.3.2006 (Annexure-5) passed by the Minimum
Wages Authority in the aforesaid CWP No.6336/2007 as
has found :
"The discussion aforesaid leads to the
conclusion inevitable that the present
one and the cognate writ petitions
challenging the common order dated
29.3.2006 are absolutely bereft of
substance and are rather of an
unnecessary litigation. This Court
cannot help commenting that even in the
face of clear operation of the statute
and the just order made by the Authority
concerned for payment of minimum wages to
the workmen and then for recovery in
accordance with law from the contractor,
the petitioner has still chosen to take
up the matter by way of these writ
petitions. Noteworthy it is that none
other than the petitioner-Government of
Rajasthan itself had prescribed the rates
of minimum wages; and when the fact
remains undeniable that the persons who
had worked on its establishment were not
made the payment of minimum wages,
instead of answering to the requirements
of a government of welfare State and
respecting the requirement of law, the
petitioner has chosen to indulge into
this unnecessary litigation that has to
legs to stand, whether in law or in
equity. This writ petition and cognate
matters do not merit any consideration
further."
(3.) In view of the decision aforesaid, the writ
petition is dismissed.;
