JUDGEMENT

(1.) By filing this petition the petitioner has prayed that respondents be restrained from removing the petitioner from the post of Receptionist, to regularize the service of the petitioner on the post of Receptionist as also to give him the pay -scale 1280 -2000 from the date of his initial appointment. Brief facts of the case according to the petitioner are that the petitioner was appointed on the post of Receptionist on 1.6.1984 for a period of three months on a consolidated pay of Rs. 300/ - on contingent basis, which was later -on extended from time to time. Petitioner after completion of one year service submitted a representation in June 1985 for regularizing him on the post of Receptionist. On 9.7.1985, on demand, the post of LDC was transferred in the office of field Director, Tiger Project, Sariska. On 24.7.1985 the petitioner was appointed on the post of LDC -cum -Receptionist on temporary basis and was later -on confirmed. The petitioner has further stated in the writ petition that in spite of availability of sanctioned post of Receptionist in the department, the petitioner was given appointment on the post of LDC (Receptionist). The petitioner has further stated in the writ petition that as he is working since last 11 years, therefore, he is entitled for pay of Receptionist on which he actually worked from the date of appointment, which is higher than the grade of LDC. On 27.6.1996, a reminder was sent by the respondents to get one post of Receptionist sanctioned from Head Office but with no result. Being aggrieved with the aforesaid inaction on the part of the respondents, the petitioner has filed the instant petition before this Court.
(2.) Respondents filed a detailed reply and controverted the facts. The respondents have stated in the reply that the petitioner was engaged to look after the work of receptionist on the fixed pay. The respondents also mentioned certain other facts.
(3.) Rejoinder to the reply was also filed by the petitioner in which the petitioner controverted the facts mentioned by the petitioner.;
