JUDGEMENT

(1.) Both these appeals are decided by this common judgment as they involve identical controversy. For the purpose of adjudication, we shall refer to the facts in Ganpat Nath's case.
(2.) The appeals are directed under Section 18 of the Rajasthan High Court Ordinances. The Special Appeal No. 587/95 is directed against the judgment and order of learned Single Judge in S.B. Civil Writ Petition No. 3170/92 passed on 20th July, 1995. The Special Appeal No. 769/95 is preferred against the order dated 24th July, 1995 in S.B. Civil Writ Petition No. 4698/93, following the judgment dated 20.7.1995.
(3.) The facts involved are that the Excise Commissioner for Rajasthan invited tenders for grant of license for sale of 'lence poppy heads' and 'bhang' for the year 1989-90, renewable for the next financial year. The said notification inviting tenders is contained in Annex. 1 to the writ petition. Certain directions were issued for the grant of license and also for fixing minimum exclusive privilege amount on which the license can be given. The appellant submitted his tender for the Mawli, Nathdwara, Deogarh group/area, for the amounts as under:
