JUDGEMENT

Kanwaljit Singh Ahluwalia, J. - (1.) The present writ petition has been filed under Article 226 of the Constitution of India, praying that the respondent be directed to regularize the services of the petitioner and make him semi permanent employee and furthermore, the respondent be directed to adhere to the principle of equal work equal pay and follow the dictum laid by the Supreme Court in the case of State of Punjab & Ors. vs. Jagjit Singh & Ors., 2017 1 SCC 148, Civil Appeal No.10356/2016 (SLP(C) No. 31676 CCNo. 15616 of 2011), .

The learned counsel for the petitioner during the course of arguments has submitted that he shall not press the prayer for regularization and shall urge this Court that the respondent be directed to pay minimum pay scale as is being paid to other coemployees including to the persons who are junior to the petitioner.
(3.) Briefly stated, the petitioner on 20.6.1986 was engaged on daily wage basis, as Baildar. The petitioner continued to work with the respondents for period of eleven months when his services were dispensed with. The petitioner raised an industrial dispute before the Labour Court, Bharatpur and the said labour court vide award dated 11.6.1999, held removal of the petitioner as bad in the eyes of law and the petitioner was reinstated into service with all consequential benefits including continuity of service. Aggrieved against the award dated 11.6.1999, the respondent filed a writ petition bearing SBCWP No.4772/1999 in this Court. The said writ petition was disposed of and the award of the labour court so far reinstatement of the petitioner and other benefits were concerned, was maintained, however, back-wages were denied to the petitioner.;
