JUDGEMENT

(1.) All these petitions involve identical questions of law and fact, hence are decided by this common order. For convenience, we have taken the facts from DB Civil Writ Petition No. 6237/2014.

By way of this petition, the management has challenged the order passed by the Rajasthan University, Jaipur dt. 9/5/2014, by which it denied to accept the examination forms of 26 students, assigning the reason that such admitted students will not now complete the requisite 200 teaching days of the course, as per Rules. However, it is submitted that as per NCTE norms the student of B.Ed. Course are mandatorily required to complete 200 teaching days before commencement of examination i.e. upto 21/7/2014 computing six days in a week and/or 36 working hours.

The case of the petitioner-Institution, however is that in terms of the letter dated 5/3/2014, the Joint Secretary, Higher Education, Government of Rajasthan, Jaipur required that the minimum working days and working hours per week as provided in the Regulations of 2009 could be completed by holding of additional classes on Sundays & holidays and even two sessions each day which shall be counted as two days on a given day. In pursuance to the letter dt. 5/3/2014, written by the State Government, whereby it was communicated that there are deficiencies in the attendance of the students on the basis of which they declined them to appear in the written examination and grant admission, therefore, the petitioner-institution has challenged the said letter.;
