JUDGEMENT

- (1.) This is another hard case before this Court where the petitioner, an applicant for MBBS Examination -2016 commencing 29.05.2016, is being not allowed to write it only for reason of her failing to adhere to the instructions/guidelines in the prospectus issued by All India Institute of Medical Sciences Ansari Nagar, New Delhi for AIIMS Entrance Examination for MBBS Course -2016 stating that her photograph appended to the application form should have a white background.

Suman Choudhary, appearing for Mr. Saransh Saini, for the petitioner has submitted that even though an application otherwise complete in all aspects including the examination fee was submitted online, the issue of photograph with the white background escaped the notice of the petitioner in the first instance and thereafter even though she was informed to rectify her examination form as submitted, but she could not do so because of her not being technically savvy .
(3.) . R.D. Rastogi, ASG appearing with Mr. Ashish Kumar, for the respondents has vehemently submitted that the petitioner was given three opportunities to make the requisite correction in her examination form but failed to do so. It has been submitted that lacs of students write the online MBBS examination each year and in the event the conditions of making the application as set out in the prospectus are not adhered to and yet the applicants are allowed to write the examination it would potentially lead to administrative chaos resulting in derailing entire examination. Learned A.S.G. further submitted that the petitioner cannot plead lack of understanding of English language inasmuch as the MBBS examination is in English medium alone and the entire course also similarly is to be conducted in English language. It has been submitted that in the circumstances, the petitioner has no case.;
