JUDGEMENT
-
(1.) The life convict Gulab Ram preferred this jail appeal from the Central Jail, Jodhpur against the judgment dated 23.3.2007 passed by the learned Addl. Sessions Judge, Sojat City in Sessions Case No.2/2006 whereby the accused appellant Gulab Ram was convicted for offence under Section 302, 307, 326 and 324 IPC and following punishment was imposed against him:

(2.) As per prosecution case, an FIR was registered against the accused appellant at Police Station Sojat City, upon written complaint (Ex.P/1) filed by the complainant Shanti Lal (PW 1) in the Government Hospital, Sojat City. In the written complaint an allegation was made that daughter of his elder father Chandra Ram Smt. Jamuna was married with one Madan Lal S/o Khiya Ram. The father-in-law of Jamuna died seven days back, therefore, his cousin brothers Bhunda Ram son of Chandra Ram and Raju Ram S/o Chandra Ram went to the house of their sister Jamuna for condolence where they participated in the programme in which religious songs were signing by the family members and relatives. In the night at 1'O Clock on completion of programme everybody were trying to sleep at the same place. At about 1.30 to 2.00 am, the accused appellant Gulab Ram S/o Khinya Ram suddenly come out from the house having sword in his hand and inflicted injury upon the neck of Bhunda Ram who was sleeping in the premises. The accused appellant Gulab Ram inflicted second injury by sword to Raju Ram, brother of Bhunda Ram. In the meantime, the sister of Bhunda Ram and Raju Ram, Smt. Jamuna came there for rescue but accused appellant Gulab Ram inflicted injury upon the hands of Smt. Jamuna also.
(3.) The neighbors Durga Ram immediately intervened but Gulab Ram gave threat to him while rounding the sword and said I will kill all of you. Upon hearing hue and cry of the injured, many persons came on spot and accused appellant Gulab Ram ran away from the place of occurrence, while taking sword in his hand.;
