JUDGEMENT

(1.) The present writ petition has been filed under Article 226 of the Constitution of India seeking to challenge the order dated 31.12.2014 rejecting the prayer of the petitioner for grant of voluntary retirement with immediate effect.
(2.) In brief, the facts are that the petitioner was working on the post of Junior Specialist in the respondent-department. On completion of more than 15 years of qualifying service, in term of Rule 50(1) of the Rajasthan Civil Services Pension Rules, 1996 (for short 'the Rules of 1996'), the petitioner submitted an application on 14.11.2007 seeking voluntary retirement with effect from 01.04.2008. Second application seeking voluntary retirement was also rejected on 06.04.2009. The petitioner moved several other representations seeking voluntary retirement but all stood rejected. On 18.12.2014 another application was moved and by the impugned order dated 31.12.2014 the application was again rejected on the ground that there is a shortage of doctors. Aggrieved against the rejection of the said application, the present writ petition has been filed.

Dr. Nupur Bhati, learned counsel appearing on behalf of the petitioner submits that to date, no enquiry is pending against the petitioner and as such the petitioner is entitled, on completion of more than 15 years of qualifying service to seek voluntary retirement under Rule 50(1) of the Rules of 1996.;
