JUDGEMENT

(1.) The present appeals arise from a common order dated 31/03/2015 allowing the writ petition holding that the respondent was entitled to consequential benefits notionally but without any backwages consequent to acquittal in appeal.
(2.) The analogous appeal has been preferred by the respondent questioning grant of notional benefits only and denial of backwages.
(3.) Learned counsel for the appellant submitted that the respondent was a Conductor in the Rajasthan State Road Transport Corporation (hereinafter called the "Corporation"). He was apprehended carrying eleven passengers without tickets though he had taken money from them and was proceeded with under Section 8 of the Rajasthan State Transport Service (Prevention of Ticketless Travel) Act, 1975 (hereinafter called the "Act"). He was convicted by the Magistrate. The acquittal in appeal is not on merits, but technicalities holding that there was no admission by him, and the matter ought to have been tried in accordance with law. The appellate court was satisfied that the matter required remand but refrained from doing so considering the passage of time and quantum of punishment that could be imposed. The allegations constituted moral turpitude.;
