K.S.RATHORE, J. - (1.) HEARD learned counsel for the petitioners and perused the impugned order dated 28.1.2005 by which the Claims Tribunal awarded Rs. 50,000/- as interim award under Section 140 of the Motor Vehicles Act.
(2.) THE petitioners have challenged the impugned order to the extent of depositing the said amount in the fixed deposit for the period of five years. The interim award under Section 140 of the M.V. Act is passed to maintain the family even for no fault liability, therefore, in the interest of justice, I deem of proper to MACT, Sikar to disburse Rs. 50,000/- to the petitioner claimants immediately. The impugned order dated 28.1.2005 is modified to that extent only.
(3.) THE writ petition stands disposed of as indicated above. Petition allowed.;
