JUDGEMENT

- (1.) By this petition for writ, the petitioner, a convict prisoner, has claimed emergent parole for a period of 30 days to get his house repaired. It is stated that the petitioner is a member of Scheduled Tribe and is residing in a small village at a distance of 25 kms. from the town of Abu Road. His house has been damaged due to heavy rains and no other member of his family is in position to get the same repaired. According to the averments contained in the petition, in the house aforesaid, wife of the petitioner with his two minor daughters is residing. He is having apprehension of causing any unwarranted incident due to damaged condition of the house. Learned Government Advocate after availing necessary instructions from the Superintendent, Central Jail, Jodhpur submits that the petitioner is a life term prisoner being convicted for the offences punishable under Secs. 302, 323 and 459 IPC. The appeal preferred by him too has been dismissed by this Court by the judgment dt. 17.01.2008. He has already undergone sentence for a period of 6 years 2 months and 22 days as on 31.07.2015 and has also availed first regular parole in the month of March 2015. The jail conduct of the petitioner is satisfactory.
(2.) It is not in dispute that District Sirohi and its subdivision Abu Road had heavy rains during the current monsoon. It is also a fact accepted that the convict -prisoner is a member of an aboriginal community and his residence is in a small village, namely, Chandela Fali Aba Beri. Having considered these facts, we deem it appropriate to accept this application. Accordingly, the same is allowed. The respondents are directed to release the petitioner on parole for a period of 15 days, provided he furnishes two sureties of Rs. 25,000/ - alongwith a personal bond of Rs. 50,000/ - to the satisfaction of the Superintendent, Central Jail, Jodhpur. The Superintendent, Central Jail, Jodhpur while releasing the petitioner on parole shall be at liberty to impose other appropriate and reasonable conditions to ensure his return to the State custody after availing the parole. The Registry of this Court is directed to send a certified copy of this order to the Superintendent, Central Jail, Jodhpur with a specific direction to convey decision of this Court to the convict -prisoner within a period of 3 days from the date of receipt of the order.;
