JUDGEMENT

- (1.) By this revision petition filed under Section 115 of the Civil Procedure Code (for short 'the CPC') the petitioner-defendant are challenging the validity of Order dated 21/05/2015 passed by the learned Civil Judge (J.D.), Kishangarh, District Ajmer (hereinafter referred to as 'the learned trial Court') in civil suit No. 38/2014 whereby, the learned trial Court dismissed the application filed under Order 7 Rule 11 of the CPC by the petitioner-defendant.
(2.) The facts giving rise to this revision are that the plaintiff-respondent No. 1 filed a suit for eviction and recovery of rent against the petitioner wherein, it is stated that the respondent No. 1 is registered with the respondent No. 2. It is a Hereditary Trust whose chief trustee was Jhanwari Lal Agrawal and after his death his legal representatives were trustees and presently Banwarlal and Brajesh Kumar are trustees. The petitioner is a tenant of Godam No. 7 @ 101 per month. The respondent No. 1 is the landlord of the property in question. A notice under Section 106 of the T.P. Act was served upon the petitioner by which the tenancy of the petitioner has been terminated.
(3.) A written statement is filed by the petitioner wherein he denied the allegation made in the plaint.;
