JUDGEMENT

- (1.) The present writ petition has been filed under Article 226 of the Constitution of India praying that writ in the nature of mandamus be issued and respondent No.2, Director of Directorate Education be directed to issue order for extension of affiliation already granted to the petitioner and respondent No.3 University of Rajasthan be directed to declare result of the students of the college, who have appeared in BBA and B.Com examination.
(2.) Mr. Mahendra Singh, the learned counsel appearing for the petitioner contended that when the Nation was facing onslaught of western education, few well meaning persons in order to inculcate and preserve glorious traditions of Indian value based education, created Bhartiya Vidya Bhavan, an Education Society registered under the Bombay Societies Act. Eminent educationist and freedom fighter Shri K.M. Munshi was founder of Bhartiya Vidya Bhavan. He formulated a trust to realize dreams of Mahatma Gandhi, father of the nation regarding dispensation of education in Indian milieu by harmonizing best of western and Indian values. It is urged that Bhartiya Vidya Bhavan (hereinafter called 'Bhavan') created various institutions through out the length and breadth of the country.
(3.) It is contended that Bhavan stands for reintegration of Indian culture and the Bhavan is wedded to arrange for and provide means which would ensure that no Indian youth possessiong character and having faith in Bharta and her culture, and Bhartiya Vidya is left without educational equipment by reason merely of want of funds. From the last so many years, Bhartiya Vidya Bhavan according to counsel is running various institutions of excellence in education and various states invite Bhartiya Vidya Bhavan to establish its institutions in respective states. Thus, Mr. Mahendra Singh, the learned counsel appearing for the petitioner-institution has submitted that the institution is charging very moderate fee as compared to other institutions. It is further pleaded in Para 2 of the petition that petitioner is non-aided and non-profit earning educational institution.;
