- (1.) Heard learned counsel for the parties. Perused the material available on record.
(2.) The instant second bail application under Section 439 Cr.P.C. has been filed by the petitioner who is in custody in connection with F.I.R. No.138/2015, Police Station JNV Colony, Bikaner for offences under Sections 8/15, 25 and 29 of the NDPS Act.
(3.) Facts in brief are that the S.H.O., Police Station J.N.V. Colony, Bikaner acting on a prior information stopped a Truck No.PB 29M 8980 on 15.6.2015 at 11:05 AM and recovered about 40 quintals of contraband poppy straw therefrom. Three persons namely Harinder Singh, Daljeet Singh and Nahar Singh were found present in truck and were apprehended at the spot. Prior thereto, the seizure officer also stopped a Bolero Vehicle No.RJ 13 UA 5305 with the allegation that the said Bolero vehicle was escorting the aforesaid truck. Three persons namely, Dhanraj, Bhagwana Ram and the present petitioner Manmohan Singh who were found present in Bolero vehicle were arrested with the charge of abetting the transportation of the contraband poppy straw. During investigation, call detail records of the accused persons were collected and charge -sheet has been filed.;
