JUDGEMENT

- (1.) The present writ petition has been filed under Article 226 of the Constitution of India, praying that the respondents be directed to issue approval/affiliation to the petitioner for opening ITI without NOC from the State Government as per old guidelines.
(2.) This Court on 19.10.2015 had passed the following order:- "Ms. Anupama Chaturvedi, the learned counsel appearing for the petitioners, in the present case, has submitted that during pendency of the writ petition, a similar matter between the parties has been decided by the High Court of Delhi at New Delhi, vide its judgment dated 24.09.2015, annexed with the present application as Annexure-12. Counsel appearing for the petitioners further submitted that the writ petition itself may be disposed of in terms of the order passed by the High Court of Delhi at New Delhi as State of Rajasthan had conceded the case of the petitioners in that case before the Delhi High Court. Mr. R.D. Rastogi, the learned Additional Solicitor General appearing for the respondent Nos. 1 and 2 and Mr. D.V. Tholia, the learned Additional Advocate General appearing for the respondent Nos. 5 and 6, prays for a short adjournment to make the statement whether the case of the present petitioners is covered by the order passed by the High Court of Delhi at New Delhi or not. List this case on 02.11.2015, as prayed. A short adjournment has been granted because it is contended by the Counsel appearing for the petitioners that the High Court of Delhi at New Delhi has fixed 03.11.2015, as a last date for admission. Let a copy of this order, under the seal and signatures of the Court Master be handed over to Mr. R.D. Rastogi, the learned Additional Solicitor General appearing for the respondent Nos.1 and 2 and Mr. D.V. Tholia, the learned Additional Advocate General appearing for the respondent Nos. 5 and 6 for onward transmission and necessary compliance."
(3.) The learned counsel for the parties are in agreement that the case of the petitioner is squarely covered by the judgment rendered by Delhi High Court in W.P.(C) No. 8849/2015 Mata Santosh Devi Private ITI vs. Directorate General of Employment And Training & Others decided on 24.9.2015.;
