- (1.) Heard on admission.
(2.) By this petition, the petitioners have prayed for the following main reliefs:- "1. To issue an appropriate writ and direct the respondent to modify the Rajasthan Services of Engineers and Allied posts (Public Health Branch) (Amendment) Rules 2015 dated 20-04-2015 (Annexure-7) to the extent of substituting the B.Sc. qualification with Ist year Science or equivalent for filling up the post of Junior Chemist under promotion quota. 2. To issue an appropriate writ and direct the respondent to provide suitable alternative e.g. as proposed in U.O.Note so as to provide an effective channel of promotion to all the Senior Lab Assistant, who do not possess the requisite qualification of B.Sc but are working from past more than 20 years on the post of Sr.Lab Assistant. They may also be directed to consider the case of the petitioners for further promotion, sympathetically."
(3.) In the year 1980, the petitioners were appointed on the post of Junior Lab Assistant. The recruitment was made in accordance with the Rajasthan Engineering Subordinate Service (Public Health Branch) Rules, 1967 (in short "Rules of 1967"). The petitioners have the qualification of Ist year Science or equivalent academic qualification from a recognized institution. They, after having five years' experience as Junior Lab Assistant and with the qualification of first year Science or equivalent academic qualification, became eligible for promotion to the post of Senior Lab Assistant. In the year 1990, all the petitioners were promoted to the post of Senior Laboratory Assistant.;
