JUDGEMENT

These petitions are directed against the order of the Central Administrative Tribunal dated 8.2.2006 which was relied upon later-on by the Tribunal in its order dated 1.3.2006, but since the issue is common in both the writ petitions, with consent of parties, both the writ petitions are being decided by the present order.
(2.) The facts are being noticed in the case of Balbir Singh CWP-2004/2006. The respondents herein were engaged as Casual Workers to perform the work of loading/unloading of Coal from railway wagons under the control of Mechanical Department in Jaipur Division, and it was performed at the Loco Shed and the present respondents worked on various dates from 1988 to 1992. While the respondents and others were performing the work of loading/unloading of Coal, in all 32 candidates preferred Original Application before the Principal Bench of the Tribunal at New Delhi, seeking directions to the railway administration to make them regular in suitable Group-D post.
(3.) Initially, the Principal Bench of the Tribunal, New Delhi, while relying on a decision of the Jodhpur Bench of the Tribunal in Original Application No.581/1988 Om Prakash & Others v. Union of India & Others decided on 21.1.1992, directed the railway administration to consider suitability of employees/applicants and other similarly situated workers on the basis of their respective length of service and other relevant criteria, and accommodate them as Casual Labourers wherever vacancies exist in accordance with the scheme under preparation.;
