The appellant/claimant, Govind, has filed the present misc. appeal under Section 173 of the Motor Vehicles Act, 1988, against the order dated 21.08.2007 passed by learned Judge, Motor Accident Claims Tribunal, Pali in M.A.C. Case No.24/2006- Govind Vs. Vega Ram & Ors., whereby the learned Tribunal has awarded compensation to the appellant/claimant to the tune of Rs.65,000/- and prayed for enhancement of the compensation to the appellant/claimant. The relevant findings of the learned Tribunal about injuries etc. are quoted herein below for ready reference: - 1639226-1

The appellant/claimant filed claim petition claiming compensation for the injuries suffered by him in an accident which occurred on 14.07.2005 at 02.00 PM while he was going from Ghandhi Chowk to Railway Station, Pali on a motorcycle bearing No.RJ-19M-8821 with his friend, namely, Anand Prakash (Appellant in CMA No.190/2008, decided today). Their motorcycle was hit backside by Truck (RJ-07-G-4647), which was plied by its driver, Vega Ram, (respondent No.1 herein) rashly and negligently. In the aforesaid accident, the claimant/appellant sustained various injuries on his body and also sustained two fractures in the elbow and tibia and fibula.

Having heard the learned counsel for the appellant/claimant and the respondents/non-claimants, and considering the facts and circumstances of the case, it is considered a fit case to award a lump sum amount of enhancement of Rs.25,000/- in addition to what has already been awarded by the learned Tribunal. The judgment and award passed by the learned Tribunal dated 21.08.2007 shall stand modified accordingly. The said enhanced sum of Rs.25,000/- (Rupees Twenty Five Thousand only) be paid to the claimants with interest within a period of three months from today. The said amount shall bear the interest @ 9% per annum from the date of filing of the claim petition till the date of payment.;
