JUDGEMENT

(1.) THE case was called out. No one appears for the petitioner.
(2.) IN this writ petition, the petitioner has prayed for the following reliefs: -
"(i) The respondent No.1 may kindly be directed to quash and set -aside the Lease Deed dated 17.4.1993 (Annexure -1) and the land allotment letter dated 21.3.1988 (Annexure -2) may kindly be quashed and set -aside in pursuance of the order dated 28.1.2011 passed by Hon'ble Supreme Court passed in SLP(C) No.3109/2011 titled Jagpal Singh and Others Vs. State of Punjab and Others;
(ii) Any other relief as this Hon'ble Court may deem fit and proper be also passed in favour of the petitioner."
(3.) WE are informed by learned counsel appearing for Ambuja Cements Limited -respondent No.3, that the writ petition [D.B.Civil Writ Petition No.5135/2008 (Chaina Ram and Anr. Vs. State of Rajasthan and Ors.)], in public interest, was filed, at the Principal Seat, Jodhpur, with regard to the allotment of the same land, namely, 324 bighas 2 biswas, comprising of khasra No.486 of Village Khun, earlier recorded in the revenue records as pasture land. A challenge was made to the allotment of land to the respondent No.3. The writ petition was dismissed on 06.04.2009 by Division Bench of this Court with the findings that the facts given in the writ petition were not correct, and that, roughly around 200 bighas of land, from out of khasra No.486, will still remain as pasture land, and that the course of water flow is on the other side. The writ petition was also found to be grossly belated, as it was filed after a period of 20 years, after allotment was made in 1980, and further, that the provisions of the Tenancy Act, apply only to the land held for agricultural purposes.
We find substance in the contention of learned counsel appearing for the respondent No.3 that in this writ petition, the petitioner has concealed the fact of filing of the earlier writ petition, challenging the same allotment, and the judgment rendered therein, for oblique purpose.;
