S.K. Keshote, J. - (1.) THE Official Liquidator has produced two documents and the same are taken on record as Court Document Nos. 1 and 2.
(2.) HAVING gone through these two documents I am satisfied that the registered office of the Company is situated in the State of West Bengal. The details of the Company are as under, 1. Name of the Company : M/s. Aditya Gears Limited 2. Registration Number : 21 -73555 Date of Incorporation: 21 -8 -1995
(3.) ADDRESS of the Regd. Office: 21, Princep Street, 1st Floor, Kolkata -700072. 3. This petition has been filed in the wrong court. 4. Accordingly the orders, dated 10 -4 -2002, 23 -8 -2002 and 17 -10 -2003, are recalled and the winding -up petition is dismissed. The Official Liquidator is directed to supply a Xerox copy of these documents to Shri R.B. Mathur, the learned Counsel for the petitioner. The petitioner is at liberty to apply for revival of this petition in case it proves that the respondent Company is situated in the State of Rajasthan. ;
