JUDGEMENT

(1.) This revision petition has been filed by the complainant-petitioner against the judgment dated 15.5.1996 passed by the, learned Special Judge, Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, Cases, Ajmer by which he has acquitted the respondents No. 2 & 3 from the charges u/ss. 341, 323 and Section 3(x) of the Scheduled Caste & Scheduled Tribes (Prevention of Atrocities) Act, Cases.

Learned counsel for the petitioner has only argued that in the impugned judgment, in para 8, the learned Judge has observed that by the prosecution evidence it has been proved that the complainant-Vijay Lal belongs to "Jachak" Caste and not by Caste "Dholi" which is not correct and against the record. He has also argued that the petitioner is a Government employee and has got employment due to "Dholi" Caste and the "Dholi" Caste falls under the category of Schedule Caste.
(3.) I have given my thoughtful consideration on the argument advanced by the learned counsel for the petitioner. Since, the petitioner has not challenged the impugned judgment of acquittal by way of appeal, he has only filed this revision petition just to safeguard his employment which he has gained on the basis of "Dholi Caste" which falls under the category of Scheduled Caste. No doubt, the present proceedings were initiated in the trial Court on the basis of first information report of petitioner-Vijay Lal and after necessary investigation, the Challan was produced before the trial Court under the aforesaid offences. The prosecution was launched against the respondent under the SC and ST (Prevention of Atrocities) Act, Cases as the petitioner is a member of the Scheduled Caste. Learned counsel for the petitioner has also submitted some documents alongwith this petition which goes to show that he belongs to "Dholi" Caste which falls under the category of Scheduled Caste. Since, the petitioner is apprehending that his employment which he gained on the basis of Scheduled Caste may come in his way by the observations made by the learned Judge.;
