This writ petition has been filed by six petitioners, namely, Yogesh Kumar Varshney, Sanjeev Kumar Vaid, Kamlesh Chandra Joshi, Bhoopendra Sharma, Narendra Paliwal and Praveen Kumar Sharma, in the year 1995, inter-alia, with the prayer that respondents be directed to determine the vacancies of Assistant Engineer and to apportion those vacancies in between the direct recruitees and promotees quota and they be further directed to apportion the vacancies of direct recruitment quota as per regulations existing as on 01.01.1993 in between two categories - open market candidates and departmental candidates, and if, as per quota, less appointments have been made, the respondents be directed to make further appointments as per the Regulation. It has also been prayed that respondents be directed to fill up the vacancies of Assistant Engineer from direct recruitment quota, which are lying vacant out of the wait merit list and if the petitioners are within the zone then the respondents be directed to appoint them as Assistant Engineer, with all consequential benefits from the date they were entitled for the same.

Thereafter the petitioners amended the writ petition and further prayer was made to the effect that the respondents be directed to grant promotion on the post of Executive Engineer to petitioners with all consequential benefits from the date persons junior to them have been promoted on the said post vide order dated 16.01.2009 and further to consider them for appointment on the post of Assistant Engineer under 1/3rd direct recruitment quota as departmental candidate against the vacancies of the year 1994 and to appoint on the said post with effect from the date persons junior to them have been promoted on the said post with consequential benefits.

Further prayer made is that the petitioner no.4 be treated to have been appointed as Assistant Engineer against 2/3rd open market category quota against the vacancies of the year 1993 being second next candidate available from the merit list and other petitioners be treated to have been promoted against 2/3rd open category against the vacancies of the year 1993-94 as per their merit.;
