JUDGEMENT

(1.) CONTENTION of learned counsel for the petitioner is that petitioner was working on the post of Conductor with the respondents - Rajasthan State Roadways Transport Corporation. On 19.11.2011, petitioner suffered acute Anterior Myocardial Infraction and was admitted in S.B. Mittal Memorial heart and Critical Care Hospital, Sikar, wherefrom he was referred to S.M.S. Hospital, Jaipur, but due to non -availability of doctor, he was taken to Santokba Durlabhji Memorial Hospital, Jaipur and admitted there, where the petitioner underwent angioplasty. The petitioner incurred a sum of Rs. 2,45,686/ - on treatment apart from the amount of thousands of rupees incurred on medicines. Still the petitioner is on medicines. Petitioner submitted total bills of Rs. 2,45,686/ - to the respondents RSRTC for reimbursement, on 10.07.2012. Grievance of the petitioner is that respondents - RSRTC have rejected his claim vide order dated 30.07.2012 (Annexure -4) on the ground that the hospital in which he remained under treatment were not approved hospitals. Despite notice, nothing has been done so far, and the petitioner is facing acute financial crisis. Hence, this writ petition by the petitioner for quashment of impugned order dated 31.07.2012 (Annexure -4) with a direction to respondents to reimburse the amount incurred by him on treatment. It is contended that the respondents - RSRTC have adopted the Rajasthan Civil Services (Medical Attendance) Rules, 2008, which were amended in the year 2008 in order to provide reimbursement of the medical expenses incurred on treatment even in approved private hospital. Those hospitals are in the list of approved hospitals in the Government for the purpose of medical reimbursement, therefore, there is no reason for not reimbursing the medical bills of the petitioner. Learned counsel for the petitioner has referred to the judgment of Supreme Court in State of Punjab & Ors. vs. Mohinder Singh Chawla & Ors., Civil Appeal No. 16980 -81/1996 decided on 17.12.1996 and judgment of this Court in Dinesh Joshi vs. State of Rajasthan, S.B. Civil Writ Petition No. 4681/2012 decided on 1.8.2012.

HAVING regard to the facts of the case, petitioner is required to approach the Chairman/Managing Director, RSRTC, who shall have the matter examined and pass appropriate order with regard to reimbursement of the expenditure incurred by the petitioner considering the aforesaid submissions and the fact that petitioner has since been retired from services or otherwise give reasons for not doing so within a period of two months from the dale of petitioner approaching him.
