Being distressed by the order dated 28.3.2014 passed in S.B.Civil Writ Petition No.3375/2014, thereby declining his prayer for annulment of the order dated 4.3.2014 posting him as Junior Engineer, Sub Office, Nareda under Assistant Engineer (O&M), Jaipur Discom, Kotputli on reinstatement, the writ petitioner is in appeal.
(2.) WE have heard Dr.Saugath Roy, learned counsel for the appellant/writ petitioner. Shortly put, the facts relevant to be noticed are that the appellant/writ petitioner was appointed as Junior Engineer initially on 20.5.1997 and was posted at Deoli -Bisalpur (Tonk). He was, subsequent thereto, transferred from place to place, and was lastly, posted in the office of Assistant Engineer (A -1), Baran. While posted thereat, a fatal accident took place, in which one Nand Lal Suman, SSA -II died. The deceased, at the relevant time, was working under Smt.Santosh Kumari Chouhan, Junior Engineer. Thereafter, by order dated 20.1.2014, in contemplation of a disciplinary proceeding, in connection with the said incident, against the appellant/writ petitioner, he was placed under suspension with his headquarter in the office of Zonal Chief Engineer (K/Z), Jaipur Discom, Kota. By another order of the same date, Smt.Santosh Kumari Chouhan was also placed under suspension, in contemplation of a disciplinary proceeding in connection with the same incident. According to the appellant/writ petitioner, having regard to the area of work and the related responsibilities, he was not at all responsible for the accident, and in fact, the site of the accident fell within the area of operation of Smt.Santosh Kumari Chouhan.

BE that as it may, eventually by orders dated 4.3.2014, both the appellant/writ petitioner and Smt.Santosh Kumari Chouhan were reinstated, without prejudice to the disciplinary proceeding pending against them. However thereby, Smt.Santosh Kumari Chouhan, Junior Engineer, on reinstatement, was posted under SE(O&M), Jaipur Discom, Baran, and the appellant/writ petitioner was posted as Junior Engineer, Sub Office, Nareda under AEN (O&M), Jaipur Discom, Kotputli.;
