JUDGEMENT

(1.) Heard Mr.N.M.Lodha, learned Advocate General, Rajasthan assisted by Mr.Vishal Sharma and Mr.Virendra Lodha, learned Amicus Curiae assisted by Mr.Arvind Kumar Arora.
(2.) The present proceeding has been registered on the letters dated 26.7.2011 and 28.7.2011 by way of reference under Section 15(2) of the Contempt of Courts Act, 1971 (for short, hereafter referred to as 'the Act') by the then Additional District & Sessions Judge (Fast Track) No.1, Bharatpur levelling the charge of criminal contempt against the then District Collector, Bharatpur. As the records reveal, no formal notice has yet been issued in the instant proceeding under the Act.
(3.) Briefly stated, the letters aforementioned seek to impugn that though judicial orders had been passed by the learned Additional District & Sessions Judge (Fast Track) No.1, Bharatpur, amongst others, in civil execution case No.39/11, baseless and false allegations, with wrong intention and prompted by self pride, have been made by the District Collector, Bharatpur against him verbally before the District & Sessions Judge, Bharatpur thus, causing interference with and obstruction of the course of administration of justice, apart from scandalizing a court of law. A request has been made to draw up a proceeding under the Act against the District Collector, Bharatpur and also to refer the matter to the State Government for necessary disciplinary action against him.;
