JUDGEMENT

(1.) The petitioner, in the instant writ application, after having successful in the examination conducted by the Rajasthan Rajya Vidyut Prasaran Nigam Ltd. (hereinafter referred to as 'the RRVPNL', for short), for the recruitment to the post of Junior Engineer-II(C) on contractual basis, has approached this Court praying for the following relief(s):-
(a) To call for the record relevant to the case.
(b) To direct the respondents to give joining at the place of her choice.
(c) To grant cost of the writ petition in favour of the petitioner.
(d) Any other appropriate relief which this Hon'ble court may deem fit, just and proper in facts and circumstances of the case in favour of the petitioner."

Shorn off unnecessary details the essential material facts necessary for adjudication of the controversy raised are: that the petitioner was successful in the recruitment process for the post of Junior Engineer-II(C) on contractual basis for which an examination was conducted on 21st March, 2004. Vide order dated 9th June, 2005, the petitioner was offered appointment on the post of Junior Engineer-II(C) with the terms and conditions stipulated therein and was called upon to submit the joining report within seven days, failing which the offer of appointment would stand cancelled. It is pleaded case of the petitioner that on account of illness (severe Infective Jaundice), she could not report for duty in time. However, the petitioner addressed a communication dated 3rd August, 2005 to the Managing Director, Ajmer Vidyut Vitaran Nigam Limited (hereinafter referred to as 'the AVVNL', for short), along with Medical Certificate, furnishing as a genuine reason, which prevented her from reporting on duty. From the materials available on record, it is also evident that on 13th June, 2005, the petitioner addressed another communication to the Chairman and Managing Director, RRVPNL, with a request to accord her posting at District Alwar being her first priority whereas District Ajmer, was her third priority. Yet another communication dated 13th July, 2005 was addressed to the Secretary (Administration), AVVNL, Ajmer, pointing out the pendency of her representation dated 3rd June, 2005 with the Chairman and Managing Director, RRVPNL and therefore, a post be kept vacant for her in the meantime. The petitioner having received no response to her representations (Annexure-6 and 7), submitted an application in the office of the Managing Director, AVVNL, along with her Medical Certificate, but received no response. However, on an inquiry, she was informed that the matter is under consideration and she would be informed about the place of her joining.
(3.) It is in the backdrop of the aforesaid facts, the petitioner has preferred the above noted writ application. This Court vide order dated 16th December, 2005; while issuing notice of the writ application, granted an ex-parte interim order to keep one post of Junior Engineer-II(C), vacant for the petitioner. However, the ex-parte interim order dated 16th December, 2009, was vacated on 21st February, 2006.;
