JUDGEMENT
Mohammad Rafiq, J. -
(1.) THIS writ petition has been filed by petitioner Pravin Kumar Rai aggrieved by the action of the RPSC in holding separate examination of RAS for the Centre of District Dausa. It is contended that when written examination of RAS Combined Competitive Pre -Examination, 2013 were conducted on 26.10.2013 pursuant to the advertisement Dt. 18.06.2013. Due to the fact that there was lot of mismanagement and some of the candidates had torn the examination papers and some fled away with OMR sheets, the examination of Dausa centre was cancelled and subsequently fresh examination was held for the candidates of that centre alone.
(2.) ACCORDING to the learned counsel for the petitioner, in this way two sets of candidates were subjected to different standards of examination because for both of them different examination papers were given and thus there is breach of right of equality and consequently Article 14 and 16 of the Constitution of India stood violated. The RPSC had conducted the examination originally on 26.10.2013. Arrangements have to be made for conducting the examination on large scale. However, there was disruption and mismanagement only with regard to one centre at Dausa. The decision of RPSC to cancel the examination of that centre and not for the entire State cannot be said to be based on no reason and without any justification. Multiple set of examination papers for each subject have to be prepared by RPSC in advance. If already the candidates through out the State were subjected to appear in the examination on the basis of one set of examination paper, the RPSC could not be expected to again give the same paper for Dausa District wherefor another set of papers was given, therefore, the action of the RPSC cannot be faulted.
(3.) THERE is no case for any breach of Article 14 and 16 of the Constitution of India. The writ petition is dismissed.;
