JUDGEMENT

Vineet Kothari, J. - (1.) THE petitioners, Tulsa Ram Saharan and Ms. Reena Sharma, have preferred this writ petition, in this Court on 13.04.1998 seeking following relief(s): "It is, therefore, respectfully prayed that this writ petition may kindly be allowed and by an appropriate writ, order or direction: a. the impugned Advertisement Annexure -P/2 dated 17/1/98 and the interview letters in the shape of Annexure -P/3 may kindly be quashed with all consequential benefits and reliefs as if the same were never issued. b. in case during the pendency of the writ petition the selections in pursuance of Annexure -P/2 and Annexure -P/3 are conducted/made and the persons are appointed then it may kindly be declared that the entire selection process is vitiated and the same cannot be termed as valid selection in the eye of law and the same may kindly be treated as set -aside with all consequential benefits and reliefs. c. it may kindly be declared that the Collector, Jodhpur, who was appointed as the Administrator of the J.C.C.B. on 15/9/94 has become functus officio on 15/9/96 after the expiry of the period of two years as provided under section 36 of the Act, 1965 and he may be restrained; to act as the Administrator after 15/9/96. d. any other appropriate writ, order or direction which is found just and proper may kindly be passed in favour of the petitioners. e. the costs of the writ petition may kindly be allowed to the petitioners." Mr. D.K. Bhootra, learned counsel appearing for the private respondent No. 12, Jeevraj Panwar, submits that the present writ petition has become infructuous since the Advertisement issued on 17.01.1998, which is under challenge, issued by its Administrator (District Collector, Jodhpur) is not longer there and after filing of the present writ petition, the elections of the respondent, Jodhpur Central Cooperative Bank Ltd. Board have been held for almost three occasions since 1998 and, therefore, this writ petition has become infructuous.
(2.) COUNSEL for the petitioners is unable to controvert these submissions. The advertisement in question was issued by the District Collector, Jodhpur, in the capacity of then Administrator of the Jodhpur Central Cooperative Bank Ltd., and after the elections of the Board held thrice over after the year 1998, that situation no longer obtains as of now, and the selection process initiated way -back on 17/01/1998, cannot be interfered with at this belated stage particularly when the Board has now taken over change from the Administrator long back. On the statement of the learned counsel for the respondent No. 12, the present writ petition is dismissed as having become infructuous. A copy of this order be sent to the concerned parties forthwith.;
