JUDGEMENT

Harbans Lal, J. - (1.) I have heard the learned counsel for petitioner Anil Kumar, learned Public Prosecutor for the State and have perused the relevant documents placed before me.
(2.) Learned counsel for the petitioner has contended that the trial having not been concluded within 60 days from the first date fixed for taking evidence in the case, the petitioner is entitled to be released on bail in view of provision of Section 437(6) Cr.P.C. The learned Public Prosecutor could not controvert this legal contention.
(3.) Without expressing any opinion on the merits of the case at this stage but taking into consideration the submission made at the bar, the nature of the accusation against the petitioner, the materials available on record and all other facts, I deem it just and proper to grant bail to the petitioner who is in custody for over ten months.;
