JUDGEMENT

(1.) These four writ petitions involved similar facts and common question of law and, therefore, they are being decided by a common order.

In Writ Petitions No. 1837/88 and 1838/88, petitioners Mohan Lal and Shri Narain have stated that they joinder service of the Rajasthan State Road Transport Corporation (for short 'the Corporation') as Conductors in the year 1975. The petitioners have stated that in terms of settlement arrived at between the Corporation and its employees on 21.2.79, which was approved by the Board of Directors of the Corporation vide resolution No. 79/79 dated 16.4.79, the Corporation prepared a policy for appointment of Conductors as Booking Clerks. In accordance with this policy a statewise list of Conductors was prepared. An office order dated 21.8.81 was issued by the General Manager of the Corporation giving option to the existing Conductors to be posted as Booking Clerks. Both the petitioner were earlier assigned the duties of Booking Clerks notwithstanding their appointments as Conductors and they continued to work as Booking Clerks in pursuance of the policy decision taken by the Corporation. The petitioners have stated that since they were absorbed as Booking Clerks, they did not get their licences renewed in accordance with the requirements of Motor Vehicle Act, 1939 and they did not have any valid licence of Conductor for the last six years. They did not require a licence because they were working as Booking Clerks.
(3.) On 2.6.88, the Depot Manager, Jaipur (West) issued order and directed the petitioners to report for duty as Conductors. Petitioners were directed to contact the Assistant Depot Manager for assignment of duty.;
