- (1.) The petitioner has claimed promotion to the post of Reader w.e.f. January 1985 under the merit promotion scheme. He has also prayed for grant of other consequential benefits.
(2.) The petitioner joined service of Malviya Regional Engineering College, Society in the year 1969 on being appointed as Associate Lecturer in Structural Engineering. He was selected and appointed as Lecturer on 24.1.73. Before entering the service he had done his Bachelor of Engineering (Civil) and during the period of service he passed Master of Engineering (Civil). In the year 1984 he was selected for the post of Reader in Regional Engineering College, Kota. In the year 1985 he was selected for appointment as Reader in Engineering College Kurukshetra; however, did not join there because he was expecting his promotion in MREC, itself.

The Government of India, Ministry of Education and Culture, framed a scheme for merit promotion of Teachers of Regional Engineering Colleges in India and issued guidelines for giving effect to the merit promotion scheme. Nonpetitioner No. 1 adopted this scheme in its meeting held on 26.11.83. This was followed by Circular dated 2.3.1984 (Annex. 4) for giving effect to the said scheme. The petitioner as well as non-petitioner No. 2 applied for the post of Reader. One Dr. V. Venkappa had also submitted his application for the post. At the relevant time,two posts of Reader was available. Dr. Venkappa was the senior most Lecturer. Junior to him was the petitioner and respondent No. 2, Dr. S.P. Gupta was the junior most person. A selection committee was constituted by the nonpetitioner No. 1 and on its recommendations, Dr. Venkappa and nonpetitioner No. 2 were given promotion as Reader.;
