- (1.) This writ petition has been filed by the petitioner with the following prayers :- (i) by an appropriate writ, order or direction the respondents be directed to determine the vacancies in accordance with reservation quota for Scheduled Castes and Scheduled Tribes as prescribed in the roster system; (ii) by further appropriate writ, order or direction the respondents be directed to regularise the promotion of the petitioner on the post of Assistant Driller from 1977 if not from earlier year and then the petitioner may kindly be ordered to be confirmed on the post of Assistant Driller in accordance with roster system; (iii) by a further appropriate writ, order or direction the respondents be directed to regularise the promotion of the petitioner on the post of Driller by taking into consideration the regular promotion of the petitioner on the post of Assistant Driller in accordance with prayer No. (ii) and then the petitioner may kindly be confirmed on the post of driller; (iv) by another appropriate writ, order or direction the respondents be directed to grant consequential benefits of seniority, difference of pay, if any and promotion on the higher posts; (v) any other appropriate writ, order or direction which may be considered just and proper in the facts and circumstances of the case may kindly be issued in favour of the petitioner; (vi) costs of the writ petition may kindly be awarded to the petitioner.
(2.) The petitioner has stated that he had joined service of the Ground Water Department as Helper on December 20, 1963. With effect from 29.4.71 he was given ad hoc promotion as Assistant Driller and that he is being continued as Assistant Driller even till this day.
(3.) Petitioner has stated that Shri Suraj Karan Mathur, Shri Nathu Singh and eight other persons were given appointment as Assistant Drillers on ad hoc basis in the year 1971. These persons were promoted as Drillers on ad hoc basis in the year 1977. Subsequently Shri Suraj Karan Mathur and Shri Nathu Singh have been given regular promotion as Drillers vide order dated 30.7.80 (Annexure- 6) on the recommendations of Departmental Promotion Committee. Shri Suraj Karan Mathur was confirmed on the post of Assistant Driller with effect from 1.12.81 by an order dated 18.9.82 (Annexure-7).;
