JUDGEMENT
Munishwar Nath Bhandari, J. -
(1.) THE petitioner is held ineligible for the post of Livestock Assistant as two years diploma course was obtained from deemed University, whereas advertisement prescribes one/two years training course from an institution recognized by the State Government. The amended rule provides qualification as under:
Perusal of qualification quoted above reveals one/two years training of Livestock Assistant from Departmental Training Centres or Institution recognized by the Government of Rajasthan. There is nothing on record to show that institution from where qualification of diploma was obtained is recognized by the State Government. It is no doubt that it is from deemed University but it does not satisfy the rigour of the rules. It is moreso when petitioner could not even satisfy the authority of the deemed University to grant such qualifications because what degrees can be granted should be as per Sec. 22 of the UGC Act. Sec. 22 is quoted hereasunder for ready reference:
22. (1) The right of conferring or granting degrees shall be exercised only by a University established or incorporated by or under a Central Act, a Provincial Act or a State Act or an institution deemed to be a University under Sec. 3 or an institution specially empowered by an Act of Parliament to confer or grant degrees.
(2) Save as provided in sub -sec. (1), no person or authority shall confer, or grant, or hold himself or itself out as entitled to confer or grant, any degree.
(3) For the purposes of this section, "degree" means any such degree as may, with the previous approval of the Central Government, be specified in this behalf by the Commission by notification in the official Gazette.
(2.) SUB -section (3) shows that an institution can confer degrees as notified in the gazette pursuant to the previous approval of the Central Government. Learned counsel for petitioner has not produced the Notification to show that certificate of diploma conferred is one of the qualifications notified in the gazette. It is moreso when deemed University/College cannot confer certificate/degree in ignorance to the provisions of Sec. 22 of the UGC Act. In the background aforesaid, the petitioner could not satisfy about the validity of certificate conferred by deemed University. It is apart from the fact that it does not satisfy the requirement of the rule.
(3.) THIS Court has seen that deemed Universities or few Colleges are conferring certificate/degrees of certain courses not notified by the UGC in the gazette. The students undertaking course are felt cheated at the end of course. The Government of Rajasthan as well as Government of India so as the UGC are expected to take action against the defaulting institution so that career of the students may not be spoiled because of their illegal acts. In view of the discussion made above, I do not find any merit in the writ petition. It is accordingly dismissed. Stay application is dismissed.;
