Arun Bhansali, J. - (1.) HEARD learned counsel for the appellants. This appeal is directed against the order dated 13.06.2012 passed by the learned Additional Sessions Judge, Nimbahera, District Chittorgarh, whereby, the application filed by respondent No. 1 -plaintiff under Order XXXIX, Rule 1 and 2 CPC was allowed and the appellants herein were restrained from dispossessing the plaintiff from the disputed property and not to transfer the same during pendency of the suit.

AFTER hearing learned counsel for the appellants and perusing the order impugned, no case for interference in the just and proper order passed by the learned trial court in the facts and circumstances of the case is made out. The appeal is, therefore, dismissed. However, in the facts and circumstances of the case, the learned trial court is directed to decide the suit as expeditiously as possible. The stay application also stands dismissed.;
