JUDGEMENT
Gopal Krishan Vyas, J. -
(1.) HEARD learned counsel for the petitioners. Learned counsel for the petitioners submits that in the writ petition filed by the petitioners against the order of rejection of temporary injunction application, an order was passed by this Court on 04.03.2008 for maintaining status quo in relation to the possession on the land in question.
(2.) LEARNED counsel for the petitioners while inviting attention of this Court towards representation and certain photographs submits that authorities of Urban Improvement Trust Udaipur are flouting the order passed by this Court by which an order was passed to maintain status quo with regard to the possession of the petitioners. After perusing the representations Annexure -2 and Annexure -4 and photographs, it appears that there is no construction upon the land in question. More so, the petitioners themselves are standing upon the site, meaning thereby, they are in possession of the land in question, therefore, it cannot be said that the order passed by this Court is flouted by the respondents. There is no other order passed by this Court except to maintain status quo with regard to possession of the petitioners.
(3.) IN view of above, no case is made out for disobedience of the order passed by this Court, therefore, this contempt petition is hereby dismissed. However, the writ petition itself may be listed for hearing on 12.02.2013.;
