JUDGEMENT
R.S. Chauhan, J. -
(1.) MST . Farida Bano and Mr. Saeed Silavat, the accused -petitioners, and Mr. Chand Mohd., the complainant -respondent are present before this Court. They have been duly identified by their respective Counsel. Mr. Chand Mohammad informs this Court that the accused -petitioners and he belong to the same family. Although, the dispute had arisen between them, and a criminal case was filed by him, during the pendency of the investigation, he and the petitioners have settled their disputes. Therefore, he does not wish to continue the criminal proceedings, arising out of F.I.R., namely F.I.R. No. 174/2013, registered at Police Station, Beawar City, District Ajmer, for offences under Sections 420, 467, 468, 471 and 120 -B I.P.C.
(2.) MR . Biri Singh Sinsinwar, the learned Senior Counsel for the petitioners, has relied on the case of Gian Singh v. State of Punjab & Another [ : 2012 (9) SC 427], in order to argue that in case an offence has been committed more in the personal capacity, than an offence against the society, and if the parties were to compromise, then this Court has ample powers to quash the criminal proceedings for the alleged offence. Considering the fact that the parties have entered into a compromise, considering the fact that the complainant -respondent no longer wishes to pursue the criminal proceedings against the petitioners, and considering the principle established by the Apex Court in the case of Gian Singh [supra], this Court, in the interest of justice, quashes the criminal proceedings arising out of F.I.R., namely F.I.R. No. 174/2013, registered at Police Station, Beawar City, District Ajmer, for offences under Sections 420, 467, 468, 471 and 120 -B I.P.C., and discharges the petitioners from the aforementioned offences.
(3.) THE petition is, hereby, allowed. Upon disposal of the main petition, the stay application, filed therewith, does not survive; the same is also disposed of.;
