JUDGEMENT

- (1.) BY this petition for writ, the petitioner, a Woman Supervisor working in the Office of Child Development Project Officer, is claiming for grant of the pay scale of Rs.1640-2900 instead of 1400-2600 as first selection grade. A direction is also sought for grant of second selection grade on completion of 18 years of service, but no proper pleadings to claim such grant of selection grade have been made. Learned counsel for the petitioner, therefore, at the threshold submits that he wants to withdraw this petition for writ with liberty to file fresh to claim second selection grade in accordance with the Government of Rajasthan notification dated 17.02.1998. The writ petition is dismissed to the extent aforesaid.
(2.) THE petitioner entered in the service of the respondents being appointed as Woman Supervisor under an order dated 29.01.1987. The post of Woman Supervisor at the time of appointment of the petitioner was an ex-cadre post and that was included in the Rajasthan Woman and Child Development Subordinate Service on promulgation of the Rajasthan Woman and Child Development (State and Subordinate) Service Rules, 1998 (for short, hereinafter referred to as 'the Rules of 1998'). The Rules aforesaid came into force on 18.07.1998. The submission of learned counsel for the petitioner is that under the Rules of 1998, a Woman Supervisor is having an avenue for promotion to the post of Assistant Child Development Project Officer, therefore, the pay scale relating to this post under the Rajasthan Civil Services (Revised Pay Scale) Rules, 1996 should have been given as first selection grade on completion of 9 years of service.
(3.) HAVING considered the arguments advanced, I do not find any merit in the same. The appointment of the petitioner was made under an order dated 29.01.1987 against an ex-cadre post and admittedly, till application of the Rules of 1998, the same was isolated one. The respondents by treating the post of Woman Supervisor an isolated post granted first selection grade as per para 5 of the Government of Rajasthan notification dated 25.01.1992.;
