JUDGEMENT

- (1.) The petitioner'who is serving the United Commercial Bank (for short 'the respondent bank') as Officer in the Middle Management Grade Scale III (for short (MMGS-III), has filed this writ petition with a prayer for issue of direction to the respondents to declare result of the petitioner's selection for the post of Senior Management Grade Scale IV (for short SMGS-IV) and for his promotion from a date persons junior to him have been promoted.
(2.) Having joined service of the respondent Bank on 1.11.62 the petitioner got promotions as Special Assistant, Officer in Junior Management Grade Scale-I, Officer in Junior Management Grade Scale-II and lastly as an Officer in MMGS-III. He is presently holding the post in MMGS-III. A First Information Report was lodged against the petitioner on 13.3.87 containing allegations regarding his working in the capacity of Branch Manager of the respondent Bank at Udaipur. The Central Bureau of Investigation, Jaipur, which investigated the case against the petitioner ultimately submitted final report before the Special Judge, CBI, Jodhpur on 4.5.88. The same was accepted on 2.11.88.
(3.) In the meantime a chargesheet dated 29.6.88 (Annexure- 2) was served upon the petitioner for an enquiry under United Commercial Bank Officer Employees' (Disciplinary and Appeal) Regulations, 1976. This charge sheet has been issued by the Assistant General Manager, who is competent disciplinary authority in the case of the petitioner. The disciplinary authority appointed Enquiry Officer and Presenting Officer vide its order dated 11.8.88 (Annexure- 3). The petitioner submitted reply to the chargesheet and denied the allegations levelled against him.;
