JUDGEMENT

(1.) The petitioner was appointed as for a period of three months in District IDARA, vide order dated 9.11.87 (Anx. 1) at the scale of Rs. 1200/- per month on temporary basis. The term of three months was extended by order dated 23.8.88 for six months from March 1, 1988. Petitioner was informed vide Anx. 3 letter dated May 1, 1989 that your services are no more required and, therefore, you are given one month's notice and your services will come to an end on May 31, 1989. Feeling aggrieved by the said order, the petitioner has filed the present writ petition on May 12, 1989, mainly on the ground that the said order has been passed without complying with the provisions of s. 25-F of the Industrial Disputes Act.
(2.) Notices were issued on 11.7.89 to show cause as to why the writ petition be not admitted and disposed of.
(3.) Reply on behalf of respondents No. 1 and 2 has been filed on 9'.8.89 and a separate reply has been filed on behalf of respondent No. 3 on 18.4.91. Respondents in the reply have submitted that the writ petition is not maintainable as Rajasthan Adult Education Association is not a State within the meaning of Art. 12 of the Constitution of India. It has further been submitted that it is a voluntary Association and is not run by the Government Department. It is a Society registered under the Rajasthan Societies Registration Act. Along with the reply the respondents have filed a copy of the order dated 11.3.89 by which the petitioner was given an opportunity to improve her work and her term was extended to April 30, 1989. They have also produced another letter dated 19.4.89 addressed to the petitioner in reply to her communication dated 25.3.89, a report regarding Sambhar Clustre. It has further been asserted that on over all evaluation of the performance, it was found that her performance was not fit to continue her in service. They have further submitted that the post of Programme Assistant is not of a permanent nature and the services of the petitioner have been terminated on account of unsatisfactory performance.;
