JUDGEMENT

- (1.) HEARD learned counsel for the parties.
(2.) THIS writ petition (parole) has been filed by the petitioner as his application for being released on first regular parole for 20 days has been rejected by the Advisory Committee vide order dated 16.4.2012, Annexure Notices were given to the respondents who have filed their reply. From the reply, we find that the Superintendent of Jail, on the basis of nominal roll, has stated that the conduct of the petitioner in jail is satisfactory. He has undergone � of the sentence. The Social Welfare Officer has recommended the case of the petitioner for being released on first regular parole. As per letter dated 15.6.2012, he has stated that the villagers of the village have also given a favourable report about the petitioner's conduct. The only reason which is adverse against the petitioner is the report of the SP dated 16.4.2012. However, we find that so far as the report of the SP is concerned, the SP has not stated anything specific against the petitioner so as to deny the befit of parole to him. In the facts and circumstances of the case and taking into account the principles governing the release of prisoners on parole, we are inclined to allow this petition and direct that the petitioner Murli S/o Shri Matadeen at present lodged in the District Jail Alwar, shall be released on first regular parole for 20 days on his furnishing a personal bond in the sum of Rs.50,000/- (Fifty Thousand only) with two sureties of Rs.25,000/- (Twenty Five Thousand) each, to the satisfaction of the Superintendent, District, Jail, Alwar on usual terms and condition and as per rules. The Superintendent, District Jail, Alwar shall also fix the date for surrender of the accused petitioner. The petition accordingly, stands allowed as aforesaid. All corrections made in the judgment/order have been incorporated in the judgment/order being emailed.;
