- (1.) Heard learned counsel for appellant.

This intra court appeal is directed against order dated 6th July, 2006 passed by Single Bench, whereby writ petition filed by respondent Mahendra Prasad Gupta was allowed and it was directed that he be given benefit of selection scale from the date his junior Shri Gokulesh Sharma was given the said benefit.

Submission of learned counsel for appellant is that although on the post of LDC, the writ-petitioner Mahendra Prasad Gupta was appointed earlier than Shri Gokulesh Sharma, but Shri Gokulesh Sharma was promoted earlier on the post of UDC, therefore, he was senior to writ-petitioner Mahendra Prasad Gupta, however, during the course of arguments, learned counsel for appellant was unable to clarify the order passed by Single Bench wherein it was mentioned that the respondents are directed to provide selection to the petitioner as admittedly, the petitioner is senior than Shri Gokulesh Sharma with effect from the date on which Shri Gokulesh Sharma was given benefit of selection scale .;
