JUDGEMENT

(1.) THE challenge in the present petition is to the order dated 12.4.2012, passed by learned Civil Judge (J.D.) & Judicial Magistrate, Rajgarh, district Alwar, (hereinafter referred to as the trial court), in civil Suit No. 120/2009, whereby the trial court has allowed the application of the respondent no. 2 -original plaintiff filed under Order VII R. 14(3) of C.P.C., seeking permission to produce the documents as mentioned therein. The only contention raised by the learned counsel for the petitioners -defendants is that the respondent -plaintiff could have produced the documents earlier and the application under or. VII Rule 14(3), was given by the respondent -plaintiff only with a view to delay the proceedings. There is no substance in the said submission made by the learned counsel for the petitioner in as much as, admittedly the trial has not started yet and as such no prejudice is going to be caused to the petitioners -defendants, if the said documents are allowed to be produced, as observed by the trial court.
(2.) THE impugned order passed by the trial court being discretionary in nature and having been passed taking into consideration the facts and circumstances of the case, this Court is not inclined to interfere with the same, exercising limited jurisdiction under Art. 227 of the Constitution of India. The petition being devoid of merits, deserves to be dismissed and is accordingly, dismissed in limine.;
